Clear Minds provides non-clinical wellness coaching, personal development support, educational workshops, digital courses, creative community spaces, retreats, and other resources designed to promote emotional wellness, personal insight, behavioral growth, and life direction.

Our Services are:

  • Not a substitute for medical or clinical care

  • Designed to complement other wellness practices

  • Delivered by trained coaches and educators—not medical providers

We may modify, suspend, or discontinue Services at any time without prior notice.

3. Non-Clinical Nature of Services

Clear Minds is not a clinical, medical, or therapeutic service provider. The Company and its representatives:

  • Do not provide mental health counseling or psychotherapy

  • Do not diagnose or treat mental health or medical conditions

  • Do not replace the guidance of licensed medical or mental health professionals

Coaching guidance, educational resources, and personal development tools are based on behavioral insight, motivational strategies, and wellness-oriented frameworks. They should not be interpreted as medical advice, psychological assessment, or treatment.

If you are experiencing an emergency, contact emergency services or a licensed mental health professional immediately.

4. Coaching Relationship & Limitations

Coaching through Clear Minds is a collaborative, supportive, and goal-focused relationship centered on:

  • Clarity and self-awareness

  • Emotional literacy

  • Decision-making support

  • Behavioral strategies

  • Personal accountability

  • Strength-based development

You acknowledge that:

  • Coaching is not therapy or clinical care

  • Participation is voluntary

  • Outcomes depend on your personal effort and engagement

  • Clear Minds cannot and does not guarantee results

No therapist-client, counselor-client, or doctor-patient relationship is created through participation in any Service.

5. Client Responsibilities

By participating in Clear Minds Services, you agree to:

  • Engage honestly, respectfully, and in good faith

  • Share relevant information needed for effective coaching

  • Acknowledge responsibility for your decisions and outcomes

  • Seek appropriate licensed care when recommended or needed

  • Act safely and respectfully in all group or community interactions

  • Maintain confidentiality in group-based coaching or community spaces

  • Refrain from illegal, harmful, or abusive behavior

You understand that Clear Minds is not responsible for personal decisions you make based on coaching guidance.

6. Payment Terms, Billing & Refund Policy

6.1 Payment Requirements

All fees must be paid at the time of booking unless otherwise outlined in a written service agreement. Clear Minds uses third-party payment processors and is not responsible for their errors, outages, or security issues.

6.2 Refunds & Cancellations

  • Digital Courses and Products: Non-refundable once access is granted.

  • Coaching Sessions: Refunds or cancellations follow the specific terms of the signed service agreement.

  • Workshops, Programs & Retreats: Due to logistics and capacity planning, refund and cancellation terms vary and will be specified in event-specific documentation.

Clear Minds reserves the right to deny refunds if terms are violated or if requests are submitted outside stated cancellation windows.

6.3 Chargebacks

By purchasing Services, you agree:

  • Not to file chargebacks or payment disputes except in legitimate billing error cases

  • That fraudulent or unjustified chargebacks will result in immediate termination of Services

  • That Clear Minds may pursue legal action or collections for unauthorized chargebacks

7. Intellectual Property & Use of Materials

All content provided by Clear Minds—including but not limited to:

  • Written materials

  • Live or recorded videos

  • Audio content

  • Worksheets, templates, and guides

  • Digital courses and modules

  • Presentations

  • Proprietary methods, scripts, and frameworks

  • Logos, branding, and visual assets

—is the exclusive property of Clear Minds and protected by copyright, trademark, and intellectual property laws.

Clients receive a limited, personal, non-commercial license for individual use only. You may not:

  • Reproduce

  • Redistribute

  • Upload

  • Publish

  • Modify

  • Sell

  • Teach

  • Translate

  • Reverse engineer

  • Create derivative works

based on Clear Minds’ content without prior written consent.

Unauthorized distribution or reproduction may result in legal action.

8. Confidentiality & Privacy

Clear Minds maintains the confidentiality of client information to the extent permitted by law. Information may be disclosed only when:

  • Required by law

  • Necessary to prevent harm

  • Allowed by written client consent

Clear Minds is not responsible for confidentiality breaches caused by:

  • Third-party platforms

  • Other participants in group settings

  • Client negligence

9. Disclaimers, Assumption of Risk & No Guarantees

All Services are provided on an “as is,” “as available,” basis. Clear Minds makes no guarantees regarding accuracy, completeness, or results.

You acknowledge that:

  • Outcomes vary based on individual factors

  • Coaching and educational content do not guarantee emotional, financial, or behavioral improvements

  • You are solely responsible for your decisions, interpretations, and use of the material

  • You voluntarily assume all risks associated with participation

Clear Minds is not responsible for:

  • Emotional triggers or reactions

  • Misinterpretations of coaching guidance

  • Actions taken based on program content

  • Personal losses or damages resulting from participation

10. Limitation of Liability

To the fullest extent allowed by law, Clear Minds, its owners, employees, contractors, and affiliates shall not be liable for:

  • Direct, indirect, or consequential damages

  • Emotional distress

  • Psychological injury

  • Financial losses

  • Lost profits, business, or data

  • Accidents or injuries

  • Misuse of educational content

  • Service interruptions

Your sole remedy for dissatisfaction with our Services is to discontinue use.

11. Indemnification

You agree to indemnify, defend, and hold harmless Clear Minds and its representatives from all claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use or misuse of Services

  • Your violation of these Terms

  • Your actions, decisions, or outcomes based on Clear Minds’ content

12. Governing Law

These Terms shall be governed by and interpreted according to the laws of the State of Texas, without regard to conflict-of-law principles.

13. Arbitration & Dispute Resolution

Any disputes or claims arising from your use of Services shall be resolved exclusively through binding arbitration under the American Arbitration Association (AAA).

  • Arbitration will occur in Travis County, Texas

  • Each party is responsible for its own costs unless awarded otherwise

  • You waive the right to participate in class-action lawsuits

  • You waive the right to pursue litigation outside small claims court

14. Severability

If any portion of these Terms is found to be invalid or unenforceable, the remaining portions shall remain fully enforceable and in effect.
